29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Warehouse- On March 29, 2017, the employer had not performed recertification training, including an evaluation of the effectiveness of that training. An evaluation of the operators' knowledge and skill to operate the forklift safely was not being conducted at least once every three years for all powered industrial vehicle operators.

29 CFR 1910.178(m)(5)(iii): When the operator of a powered industrial vehicle dismounted and was within 25 ft. of the truck that was still in view, the load engaging means were not fully lowered, controls were not neutralized, and/or the brakes were not set to prevent movement: a) Warehouse, Dock 15- On or about March 23, 2017, the employer did not ensure that the forks on the Toyota sit down LPG forklift, Model #7FBEU20, Serial #22464, were fully lowered when the operator of the vehicle dismounted and was within 25 ft. of the truck that was still in view.
