29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition:  a) Worksite, 429 Greene Avenue, Brooklyn NY: Employees installing metal studs with a pneumatic nail gun on the 1st floor were not using eye protection; on or about 3/28/17.   Note:   The employer is required to provide abatement certification for this violation as normally required in CFR 1903.19.

29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:  a) Worksite, 429 Greene Avenue, Brooklyn NY : Employees were using a Relocatable Power Tap (#1039) to power equipment such as saw, charger, extension cord, pneumatic guns and drills; on or about 3/28/17.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:  a)   Worksite, 429 Greene Avenue, Brooklyn NY: Employee installing metal studs was using a A-Frame wooden ladder. The ladder was used for the purpose other than the purpose for which it was designed. On or about 3/28/17.  Note: Because abatement of this violation is already documented in the case file, the employer need not to provide abatement documentation or certification for this violation as normally required in 29 CFR 1903. 19.
