29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): a) Jobsite - On or about March 31, 2017, employees were operating the Ingersoll Rand Telescopic Handler (forklift) in an unsafe condition in that operators/employees had reduced visibility and awareness due to an inoperable headlight and a nonfunctioning horn on the forklift, thus exposing employees to struck-by hazards.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: a) Jobsite - On or about March 31, 2017, employees were working from a personnel platform attached to an Ingersoll Rand VR 843C forklift that was not designed to support personnel platforms, thus exposing employees to fall hazards of up to about 14 feet onto earthen ground.
