29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program.  Department of Interior employees, working at the Stones River Battlefield in Murfreesboro, TN, are exposed to noise levels (above 85 dBA, according to their written Hearing Conservation Program) when operating lawn mowing/trimming equipment and the employer did not develop and implement a monitoring program.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels.   a) Department of Interior employees, working at the Stones River Battlefield in Murfreesboro, TN, are exposed to noise levels (above 90 dBA, according to their written Hearing Conservation Program) when operating lawn mowing/trimming equipment and the employer did not obtain an annual audiogram.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The employer provides annual BBP training to employees and generates an employee training participant memorandum which listed employees names but not their job titles.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
