29 CFR 1926.651(b)(1): The estimated location of utility installations, such as sewer, telephone, fuel, electric, water lines, or any other underground installations that reasonably may be expected to be encountered during excavation work, shall be determined prior to opening an excavation. On or about April 2, 2017 and prior to that time, located on the north side of an new residential structure, the employer did not locate the reasonably expected utilities to be encountered such as electrical and gas lines while an employee was performing underground excavation work operating a John Deere Backhoe. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(b)(4): While the excavation is open, underground installations shall be protected, supported or removed as necessary to safeguard employees. On or about April 2, 2017 and prior to that time, located on the north side of a new residential structure, the employer failed to protect the underground utilities such as electrical and gas lines while the excavation was open exposing the backhoe operator to a struck-by or electrical hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
