1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. 29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary a) On or about 03/28/17, at the "Transformation of Inner Loop", area located behind the Strong Museum and at Manhole 10.3, an employee was not protected from falling excavated materials such as soil and rock, which were not scaled back away from the trench edge by at least two feet. NO ABATEMENT CERTIFICATION REQUIRED

ABATEMENT DOCUMENTATION REQUIRED Concrete Applied Technologies Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.652(a)(1)), which was contained in OSHA inspection number_1138568, citation number__1_, item number__1_and was affirmed as a final order on 01/05/2017, with respect to a workplace located at North Union Street, Olean, New York. and Concrete Applied Technologies Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.652(a)(1), which was contained in OSHA inspection number_542238, citation number__2_, item number__1_and was affirmed as a final order on 05/20/13, with respect to a workplace located at Lockport Road and Campbell Boulevard, Lockport, New York
