29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours Wal-Mart Stores, Inc. Store #1340, 5401 Fairington Road, Lithonia, GA - On March 31, 2017, an employee was hospitalized after being treated from a gunshot to the foot while attempting to apprehend a shoplifter. The employer notified OSHA on 4/04/17. The employer did not notify OSHA of the hospitalization within 24 hours, on or about 04/03/17. Wal-Mart Stores Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 1200981, citation number 1, item number 1 and was affirmed as a final order on 03/01/17, with respect to a workplace located at 1871 Chamblee Tucker Road, Chamblee, GA, 30341. Wal-Mart Stores Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1904.39(a)(2), which was contained in OSHA inspection number 11308506, citation number 1, item number 1 and was affirmed as a final order on 04/07/16, with respect to a workplace located at 65 Wal-Mart Dr., Mountain Home AZ, 72653.
