29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about 5 April 2017, and at times prior thereto, workers performing construction activities within apartment Building 10 did so without the balconies and breezeways having some form of fall protection, exposing the workers to a fall hazard of approximately 40 feet or more.

29 CFR 1926.1052(a)(3): Riser height and/or tread depth was not uniform within each flight of stairs, including any foundation structure used as one or more treads of the stairs. On or about 5 April 2017, and at times prior thereto, workers performing construction activities within apartment Building 10 were able to use a set of stairs from the 2nd floor to the 3rd floor in which the stairs were missing two treads near the 3rd floor landing, exposing the workers to a fall hazard of approximately 15 feet 10 inches or more to the landing below.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge. On or about 5 April 2017, and at times prior thereto, workers performing construction activities within apartment Building 10 were able to use a set of stairs from the 2nd floor to the 3rd floor in which the stairs were missing the railing between the 2nd floor half-landing and the 3rd floor landing, exposing the workers to a fall hazard of approximately 15 feet 10 inches or more to the landing below.
