29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: On the south end of the facility at the fuel tank area, employees required to measure fuel levels from the top of the fuel tanks were not provided fall protection and exposed to unprotected fall hazards of more than 4 feet to the concrete below.
