29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: (a) The employer did not ensure that employees working on the ground directly under employees working off of three tiered scaffolding, approximately eighteen (18) feet above them; were wearing protective helmets thereby exposing employees working on the ground to a struck-by hazard from falling masonry and/or tools.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access: (a) The employer did not ensure that each employee working off of tubular welded frame scaffolding; set up on the west side of the building and built three tiers high, was accessing it properly. Employees used cross braces and the end frames while climbing up and down the scaffolding exposing them to a fall hazard of approximately thirteen (13) feet. (b) The employer did not ensure that each employee working off of tubular welded frame scaffolding; set up on the south end of the building and built three tiers high, was accessing it properly. Employees used cross braces and the end frames while climbing up and down the scaffolding exposing them to a fall hazard of approximately twenty (20) feet.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity): (a) The employer did not ensure that each employee performing overhand bricklaying operations off a tubular welded frame scaffold set up on the west side of the building and built three tiers high were protected from a fall hazard of up to approximately thirteen (13) feet by the use of personal fall arrest system or guardrail system. The scaffoldings second tier; which the employees were working off of; only had end braces and some cross bracing installed but no railings plus none of the employees working off of the scaffoldings second tier extensions were using a personal fall arrest system. (b) The employer did not ensure that each employee performing overhand bricklaying operations off a tubular welded frame scaffold set up on the south end of the building and built three tiers high were protected from a fall hazard of up to approximately twenty (20) feet by the use of personal fall arrest system or guardrail system. The scaffoldings third tier; which the employees were working off of, had no end braces, cross bracing, or railings installed plus none of the employees working off of the scaffoldings third tier extensions were using a personal fall arrest system.
