29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard was not attached to the boom or basket when working from an aerial lift:      a) Job site, Smokey Woods Apartment Complex, Building 5: On or about April 10, 2017, during gutter replacement activities, the employer did not ensure that an employee was using appropriate fall protection systems/devices and was tied off while working in the basket of an aerial lift at a height of approximately 15 feet.     Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.454(a): The employer did not ensure that each employee who performed work while on a scaffold was trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:      a) Job site, Smokey Woods Apartment Complex, Building 5: On or about April 10, 2017, during gutter replacement activities, the employer did not ensure that an employee in an aerial lift was provided with scaffold safety training. The employee was not wearing appropriate fall protection systems/devices and was not tied off while working in the basket of an aerial lift at a height of approximately 15 feet.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that would not deflect, and a grasping device, such as a grabrail, was not provided to assist employees in mounting and dismounting the ladder:   Instances including, but not limited to, the following:  a) Job site, Smokey Woods Apartment Complex, Building 5: On or about April 10, 2017, during gutter replacement activities, the employer did not ensure that the ladder used to gain access to/egress from the roof was extended at least 3 feet above the roof line in that it was determined to have been extended 2 to 2 1/2 feet above the roof line.
