A1 Emergency Sewer and Water LLC project site located at 139 Minor Ct. Green Bay, WI: On and about April 11, 2017, employees were exposed to multiple hazards, including but not limited to, engulfment, struck by equipment and objects, and inhalation of toxic substances when the employer had not implemented the programs needed to communicate the hazards associated with sewer and water excavation work.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A1 Emergency Sewer and Water LLC project site located at 139 Minor Ct. Green Bay, WI: On and about April 11, 2017, employees were exposed to multiple hazards relating to trenching when PPE was not provided and or not enforced, in that employees cutting concrete and pipe with a gas powered cut off saw were not wearing hard hats, safety glasses, hearing protection, or respiratory protection.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. Green Bay, WI: On April 11, 2017, employees were exposed to engulfment while working in an unprotected trench when the egress ladder was laid on the ground at the end of the trench 36' away from the curb.
