29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    (a) Facility Wide - On April 11, 2017, the employer did not ensure that employees operating forklifts in the facility were competent to do so by the successful completion of forklift training and evaluation.      In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a) Blow Molding Department - On April 11, 2017, the employer failed to ensure that one or more methods of machine guarding was not provided to protect the operator and other employees in the area from hazards such as those created by moving parts. The plexiglass on the door of the Bekum B1 machine was missing allowing access into the machine.      No abatement certification or documentation is required for this item.      Midwest Can Company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard, 29 CFR 1910.212(a)(1) which was contained in OSHA Inspection Number 912421, Citation number 1, Item number 2 and was affirmed as a final order on August 29, 2013 with respect to the workplace located at 10800 W. Belmont, Franklin Park, Illinois 60131.

29 CFR 1910.22(a)(2): The floor of each workroom was not maintained in a clean and, to the extent feasible, in a dry condition.         (a) Blow Molding Department - On April 11, 2017, the employer did not ensure that all areas were maintained clean and dry condition. The oil from the H3 blow molding machine leaked on to the floor resulting in oil  accumulations around the machine.       In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification.
