29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:      a. At the worksite, on or about April 13, 2017, a scaffold system was constructed without a ladder to provide employees access to the first and second scaffold platforms, exposing subcontracted employees from Freddie Smith Repairs/Masonry to a 13-foot slip, trip or fall hazard.    b. At the worksite, on or about April 13, 2017, a scaffold system was constructed without a ladder to provide employees access to the first and second scaffold platforms, exposing subcontracted employees from H and M Masonry, LLC, to a 13-foot slip, trip or fall hazard.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a. On or about April 13, 2017, subcontracted employees working from a scaffold on the front of apartment building #2 were not protected from falling from the second platform to the lower level by fall protection and were exposed to a 13 foot fall hazard.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a. On or about April 13, 2017, at the Arbor Crossing new construction apartment building site, the portable extension ladder used by 4 subcontracted employees was not extended at least 3-foot above the upper landing surface, exposing these employees to 24-foot fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 13, 2017, when three (3) subcontracted employees from Garcia Building Company, LLC, are working to install roof sheathing panels while on the third story, 6:12 pitch steep roof, of a new construction, multi-family, apartment building at the Arbor Crossing at Buck Lake apartment complex in Tallahassee, Florida without fall protection and are exposed to fall hazards in excess of 24-foot to the ground below.    b.  The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 13, 2017, when a subcontracted employee from New South Roofing, Inc., works to install roofing components while on the third story, 6:12 pitch steep roof, of a new construction, multi-family, apartment building at the Arbor Crossing at Buck Lake apartment complex in Tallahassee, Florida without fall protection and is exposed to fall hazards in excess of 24-foot to the ground below.    Pelzer Homes, Inc. which shares the exact same ownership as Arbor Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 703618, citation number 1, item number 2 and was affirmed as a final order on November 27, 2012, with respect to a workplace located at 2750 Old St. Augustine Road, Tallahassee, FL 32301.
