29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person: On or about April 11, 2017, at St. Charles Catholic High School, the employer failed to ensure that a qualified person constructed the scaffold system. Employees used the welded tubular scaffold to apply masonry material to the structure of the building.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) On or about 4/11/17, at St. Charles Catholic High School, the employer failed to provide safety data sheets for hazardous chemicals such as but not limited to Magnolia Type S mortar. Employees were using the mortar to install brick to the building.
