29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Production Area- On or about April 17, 2017, the employer failed to establish a Lockout Tagout Program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing, maintenance or sanitation on machines, such as the SureKap Cap Machine or the Bel WFPS 5150 Box Machine, and the Formpak, Inc. Bag Dumping Station, where the unexpected energization, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.212(a)(5): Fan blade guard(s) were not provided where the periphery of the blades was less than seven feet from the floor or working level: a) Production Area- On or about April 18, 2017, the employer failed to ensure that all areas where hazards created by the moving exhaust fan blade on the Formpak, Inc. Bag Dumping Station were guarded to prevent injury to employees during the operation of the machine. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
