29 CFR 1926.20(b)(4): The employer did not ensure that the employee(s) required to operate equipment and machinery was qualified by training or experience.    On or about 15 April 2017, and at times prior thereto, two employees were operating construction equipment at a worksite without being trained and qualified by the company, exposing the employees and those working nearby to the hazard of being struck by the heavy equipment machinery.  a) A Case Backhoe Loader Super N 580 was used at the worksite to excavate a trench of mud, dirt, and debris along a concrete retaining wall.  b) A Case Compact Track Loader TV380 was used at the worksite to haul and move either debris or materials during work along two retaining walls.

29 CFR 1926.1060(a)(1): The employer did not ensure that each employee was trained by a competent person which would enable each employee to recognize hazards related to ladders and stairs, and the procedures to follow to minimize those hazards.  On or about 15 April 2017, and at times prior thereto, two workers used a Werner Fiberglass Six-Foot Stepladder for trench egress without being trained to recognize the hazards related to ladders and the steps to minimize those hazards, exposing the workers to a fall hazard of approximately 4 feet 6 inches.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees.    On or about 15 April 2017, and at times prior thereto, workers were within trenches in which the nearest egress was either beyond 25 feet away or no means for egress was being used, exposing the workers to the hazards of either falling into the trench or being caught in a cave-in or engulfment.  a) Northern trench: Two workers were working within a trench at approximately 7 to 9 feet deep in which the nearest egress was either a ladder approximately 45 feet 6 inches away to one side, or an earthen ramp approximately 33 feet away to the other side.  b) Southern trench: Three workers were working within a trench at approximately 4 feet 6 inches deep with a gravel bottom without the use of a ladder for egress.
