OSH Act of 1970 Section (5)(a)(1)       The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall and crushing hazards.      The employer is failing to protect employees from fall hazards while working from a platform elevated more than 10 feet above ground level by an all-terrain forklift.  The most recent occurrence took place at 7322 N. 168th Ave, Bennington, Nebraska where the employees were unsafely elevated using a Terex model TH842C rough terrain forklift and a 5 foot by 16 foot platform to install siding. Instances include but are not limited to:             i.        The employer placing the 5 foot by 16 foot platform in parallel fashion, extending the platform more than two thirds of the length past the forks creating an unstable working surface on the far end of the platform.      Among other methods, feasible and acceptable methods of abatement are:    a)  Ensure that all employees involved in the operation are trained and briefed prior to working with this equipment of the hazards involving elevating employees and stability issues involving this piece of equipment.     b)  Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual and follow the ASME/ANSI B56.6 2011 Safety Standard for Rough Terrain Forklift Trucks.      c)  Ensure the platform being used by the company meets the requirements of both the manufacturers requirements and the above listed ANSI Standard.

29 CFR 1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:     The employer is failing to protect employees from fall hazards associated with working on a platform that has been elevated more than 10 feet above the ground by an all-terrain forklift.  The most recent occurrence of this took place at the new home being built at 7322 N. 168th Ave, Bennington, NE where the employer has an unprotected employee lifted up into a work position greater than 10 feet from the ground below in preparation to install siding without securing the platform to the forks by means other than relying on friction to prevent the platform from sliding off the forks.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    The employer is failing to protect employees from fall hazards associated with working on a platform that has been elevated more than 10 feet above the ground by an all-terrain forklift.  The most recent occurrence of this took place at the new home being built at 7322 N. 168th Ave, Bennington, NE where the employer has an unprotected employee lifted up into a work position greater than 10 feet from the ground below in preparation to install siding without having guarded all exposed sides of the platform.  Specifically half of the side of the platform that runs along the side of the house juts past the corner of the home exposing the employee to a fall hazard of greater than 10 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     The employer is failing to protect employees from fall hazards associated with residential construction activities.  The most recent occurrence of this took place at the new home being built at 7322 N. 168th Ave, Bennington, NE where the employer has an unprotected employee climbing an aluminum ladder to access the roof to mark the walls above the entry way for the impending siding installation while exposed to a fall hazard of greater than 10 feet.
