1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a) On or about April 19, 2017; scaffold located on the North-side of building; an employee was operating a STIHL T5420 Concrete Saw without eye protection to prevent injury while cutting concrete block.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.     a) On or about April 19, 2017; scaffold located on the Northside of building; employees were using the scaffold frame and braces to access the working platform exposing employees to a 27-foot fall to ground level.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.     a) On or about April 19, 2017; scaffold located on the north-side of building; the employer did not have a competent person on site to ensure that the scaffold system had access provided to the working platform and measures taken to ensure that the employees are protected from falling 27-feet to ground level.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.      a) On or about April 19, 2017; scaffold located on the North-side of building; employees were not protected from falling 27-feet to ground level by a personal fall arrest system or guardrails while working on the open ends of the scaffold system.       b) On or about April 19, 2017; scaffold located on the North-side of building; employees were working on a scaffold system in which the mid-rails were not installed exposing employees to a 27-foot fall to ground level.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
