29 CFR 1910.136(a): The employer did not ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures:      On or about April 6, 2017, the employer did not provide or ensure the use of protective foot protection for employees tasked with moving and handling scrap material in the scrap cutting area. Metatarsal protection was required for employees working in the area. New employees however were not provided with metatarsal protection prior to working in the area.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated; the person which certified that the evaluation had been performed; the date(s) of the hazard assessment; and, which identified the document as a certification of hazard assessment.  On or about April 20, 2017, the employer did not complete a written hazard assessment for the scrap cutting area of the facility. The employer had performed such an assessment, selected the personal protective equipment, however failed to have a written certification.
