29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle, Sioux Falls, SD 57106: On and prior to April 17, 2017, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Four employees were working next to the edge of the roof on a two-story residential home without the use of a fall protection system. The subcontractor employees were installing shingles and underlayment on the main roof of the property. This condition exposed employees to a fall hazard of approximately 20 feet to the ground below. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

Kingfisher Circle, Sioux Falls SD, 57106: On and prior to April 17, 2017, the exposing employer did not ensure each employee on a walking /working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Employees were installing roofing materials while working near the edge without the use of a fall protection system. This condition exposed the employees to a fall hazard of approximately 20ft.

Kingfisher Circle Sioux Falls SD, 57106: On and prior to April 17, 2017, the employer did not ensure the back D-ring or attachment point of the body harness was on the wearer's back near shoulder level. This condition exposed the employee wearing the harness to more than the limit of 1800 lbs of dynamic force. The employee had the D-ring of the harness located on his lower back, increasing the extent of injury during a fall event. The employee was exposed to a 20 foot fall hazard.

This condition exposed employees to an approximately 8 ft. fall hazard onto the lower level garage roof.
