29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person     (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle, Sioux Falls, SD 57106:  On and prior to April 17, 2017, the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Four employees were working next to the edge of the roof on a two-story residential home without the use of a fall protection system. The subcontractor employees were installing shingles and underlayment on the main roof of the property. This condition exposed employees to a fall hazard of approximately 20 feet to the ground below.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b)     (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle, Sioux Falls SD, 57106:  On and prior to April 17, 2017, the exposing employer did not ensure each employee on a walking /working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Employees were installing roofing materials while working near the edge without the use of a fall protection system.  This condition exposed the employees to a fall hazard of approximately 20ft.

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:  (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle Sioux Falls SD, 57106: On and prior to April 17, 2017, the employer did not ensure the back D-ring or attachment point of the body harness was on the wearer's back near shoulder level. This condition exposed the employee wearing the harness to more than the limit of 1800 lbs of dynamic force. The employee had the D-ring of the harness located on his lower back, increasing the extent of injury during a fall event. The employee was exposed to a 20 foot fall hazard.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle, Sioux Falls, SD 57106:  On and prior to April 17, 2017, the exposing employer did not ensure that a  portable 16 ft. extension ladder, used to access the garage roof section of the home, had side rails extending 3 feet above the upper landing, and was secured. This condition exposed three employees to fall hazards of approximately 16 feet.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  (a)Adonias Tuchez Painting & Roofing Service at 9201 W. Kingfisher Circle Sioux Falls SD, 57106: On and prior to April 17, 2017, the employer did not ensure ladders were being utilized for their intended purpose in that, employees were utilizing an A-framed ladder on the roof of the home, leaning against a wall to gain access to the main roof.  This condition exposed employees to an approximately 8 ft. fall hazard onto the lower level garage roof.
