29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access: a. At the new construction, multi-family residential worksite, employees are climbing the components of a scaffold system while not protected from slip, trip or fall hazards in the absence of a scaffold ladder system. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on April 13, 2017, when employees were erecting a scaffold (modifying an existing scaffold) without a ladder system for the employee access to the first and second scaffold platforms while and exposed to thirteen-foot slip, trip or fall hazards, with respect to a workplace located at 3810 Buck Lake Road, Tallahassee, FL, 32317. The ownership of H and M Masonry, Inc. was previously cited under the company name of Underdog Masonry, Inc. for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 915405, citation number 1, item number 4 and was affirmed as a final order on January 13, 2014, with respect to a workplace located at 260 Park Avenue, Pooler GA 31322. The ownership of H and M Masonry, Inc. was previously cited under the company name of High Class Masonry for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 70758, citation number 1, item number 4 and was affirmed as a final order on December 28, 2012, with respect to a workplace located at 4910 North Monroe Street, Tallahassee, FL, 32304.
