29 CFR 1910.1025(h)(1): All surfaces were not maintained as free as practicable of accumulations of lead:      On or about April 20, 2017, in the motor machine shop and receiving warehouse work area, the employees worked in the loading and unloading the freight trailers with metal finished products and work surfaces were not regularly cleaned to prevent avoidable lead exposure, such as those potentially caused by re-entrained lead dust.    Monitoring was conducted to ascertain lead presence and exposure. On April 20, 2017 the wipes samples were taken to ascertain lead exposure from different work surfaces, such as, but not limited to lunchrooms, shop equipment and employees work stations and desks:    a) WIPE #1-2330.39 ug/ft2 (Back side of the store warehouse; on top surface of the left side batteries charging station);  b) WIPE #2-6202.65 ug/ft2 (Back side of the store warehouse; on the top surface of the right side batteries charging station);  c) WIPE #3-3176.34 ug/ft2 (Store warehouse; on top surface of employee right shoe);  d) WIPE #4-5492.61 ug/ft2 (Store warehouse; on top surface of employee left shoe);  e) WIPE #5-532.89 ug/ft2 (Store warehouse; on both sides of employee left hand);  f) WIPE #6-264.54 ug/ft2 (Store warehouse; on both sides of employee right hand);  g) WIPE #7-162.55 ug/ft2 (Store; Left side on top surface of front desk/work station of employee); and,  h) WIPE #8-378.58 ug/ft2 (Store; Right side on top surface of front desk/work station of employee).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about April 20, 2017, and times prior thereto, at this facility, employees involved in sales of automotive parts and batteries that contain hazardous chemicals such as, but not limited to, corrosives acids and lead.  The employer had not developed a program which would address labeling and other forms of warning on chemicals containers, Safety Data Sheets and employees information and training on the hazards associated with chemicals used at this site.  The written program must also contain the following:  a. a list of all hazardous chemicals on site; b. the methods the employer will use to inform employees of the hazards associated with non-routine tasks involving       chemicals, such as a spill; c. the hazards of chemicals contained in piping that is not labeled; and, d. the method the employer will use to inform other employers (contractors) of the chemicals their employees might        be exposed to while performing duties at this site.
