29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit:(Note:  Appendix D to 29 CFR 1910.146 presents examples of permits whose elements are considered to comply with these requirements.  On or about April 18, 2017, the employer did not have an entry permit for the workers who were cleaning out the Soil-Sement inside of the Union Tank Car Company, UTLX200083, rail car located on Midwest Industrial Supplies job site.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  On or about April 18, 2017, the employer failed to train employees on the new Global Harmonization System to include, but not limited too, safety data sheets for lubricants, coolants, and asphalt.
