OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall and crushing hazards from the improper use of mobile scaffold equipment: A. On or about April 21, 2017, CTFastrak Flatbush Avenue Station: Employees using a SkyJack SJIII 3219 scissor lift operated the equipment in a manner inconsistent with manufacturer's instructions. A custom-made stainless steel heater unit, measuring 11 feet 2 inches long by 17 inches wide and weighing 359 lbs. was balanced on the guardrails of the scissor lift, 39 inches above the work platform. The heater was fitted with two 4-foot long attachment posts, one near either end of the heater unit. The placement of the load on the guardrails affected the lateral stability of the scissor lift.

29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: A. On or about April 21, 2017, CT Fastrack Flatbush Station Jobsite: Employees working on site were not wearing cut resistant or Kevlar gloves when handling and moving a stainless steel heater unit on the guardrails of a SkyJack SJIII 3129 scissor lift, #SL-3150. An employee contacted a sharp edge at an opening in the heater, resulting in a finger amputation injury.
