29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  On or about April 21, 2017, and in times prior thereto, workers were elevated on a Sky Trak equipped with an unapproved, unstable shop built personnel basket. This condition exposed workers repairing and replacing worn portions of the rappelling surface to a fall from elevation hazard.

29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled:  On or about April 21, 2017, and in times prior thereto, workers were elevated on a Sky Trak equipped with an unapproved, unstable shop built personnel basket.  This condition exposed workers repairing and replacing worn portions of the rappelling surface to a fall from elevation hazard.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about April 21, 2017, and in times prior thereto, Sky Trak operators were not formally trained in forklift safe operations such as vehicle stability and manufacturer warnings. Workers were exposed to the hazards of falls and being struck by the rough terrain forklift being operated on slopes and banks of greater than 15%.  Specifically, operators were not trained in 1910.178(l)(3)(i)(I): Vehicle stability; and 1910.178(l)(3)(i)(M): Operating instructions, warnings and other precautions listed in the operator's manual.

29 CFR 1910.178(l)(3)(ii)(A): Powered industrial truck operators did not receive initial training in surface conditions where the vehicle would be operated that could affect safe operation:  On or about April 21, 2017, and in times prior thereto, workers were lifted in an unapproved basket on a Sky Trak that was traveling laterally on slopes and surfaces that were not level, including concrete pads and grassed embankments.

29 CFR 1910.178(l)(3)(ii)(G): Operator training did not include workplace related topics such as ramps and other sloped surfaces that could affect the vehicle's stability:   On or about April 21, 2017, and in times prior thereto, the Sky Trak forklift was operated on slopes and banks exceeding a slope of 15%. The boom was elevated with a self-made man-basket to raise workers, exposing workers to a fall hazard while repairing and replacing worn portions of the rappelling tower.

29 CFR 1910.178(n)(7)(i): Loaded industrial truck(s) ascended or descended grades over 10% with the load downgrade:  On or about April 21, 2017, and in times prior thereto, workers were lifted in a basket on a Sky Trak that was traveling laterally to a slope of approximately 17% with the boom elevated, exposing workers to a fall hazard while repairing and replacing worn portions of the rappelling tower.
