29 CFR 1926.59: NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.    29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Crown Construction Co of Chicago, Inc. did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling and other forms of warning;  2) Safety data sheet availability;  3) Employee information and training;  4) A list of hazardous chemicals known to be present in the workplace;   5) Methods to inform employees of the hazards on non-routine tasks; and   6) Methods to provide other employer(s) access to safety data sheet; information on any precautionary measures and the labeling system used in the workplace.    On or about April 24, 2017, five employees were exposed to a hazardous chemical, crystalline silica, while performing brick laying and brick cutting activities on a residential renovation construction project located at 2530 W. Berteau Ave Chicago, IL 60618. Crystalline silica was a component of the dark red smooth modular Yankee Hill brick being cut and the Brixment i.pro masonry cement being used at the worksite.       In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.59: NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.  29 CFR 1910.1200(g)(1): Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use:  a) On or about April 24, 2017 Crown Construction Co of Chicago, Inc. did not ensure that a Safety Data Sheet (SDS) for each hazardous chemical that employees were exposed to was available in the workplace. The employer did not have a SDS for crystalline silica, a component of the dark red smooth modular Yankee Hill brick being cut and the Brixment i.pro masonry cement being used at the worksite. Five employees were exposed to a hazardous chemical, crystalline silica, while performing brick laying and brick cutting activities on a residential renovation construction project located at 2530 W. Berteau Ave Chicago, IL 60618.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.59: NOTE: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.1200 of this chapter.  29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) On or about April 24, 2017, Crown Construction Co of Chicago, Inc. did not provide information and training to employees exposed to a hazardous chemical, crystalline silica, which was a component of the dark red Yankee Hill Brick being cut and masonry cement being used at the worksite.   (b) On or about April 24, 2017, Crown Construction Co of Chicago, Inc. did not provide training to employees by December 1, 2013 on the revised Safety Data Sheet format and content, as well as the new labeling elements as required by the revised hazard communication standard 29 CFR 1910.1200.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
