29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) At Hubbard Apartments, Troy, Alabama: On or about April 25, 2017 and at times prior; the employer allowed his employees to perform roofing activities on single and two story low slope roofs without providing fall protection for his employees exposing them to fall hazard of up to 19.2 feet to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) At Unit 100 Hubbard Apartments, Troy, Alabama: On or about April 25, 2017 and at times prior; the employer allowed his employees to work from a low slope roof without fall protection exposing them to a fall hazard of 9.3 feet to the ground below. (b) At Unit 102 and 104 Hubbard Apartments, Troy, Alabama: On or about April 25, 2017 and at times prior; the employer allowed his employees to work from a low slope roof without fall protection exposing them to a fall hazard of 19.2 feet to the ground below. THE PHILLIP BURT DBA A PLUS HOME IMPROVEMENTS WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501 (B)(11) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1170766 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 24, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 1996 HIGHWAY 14 SOUTH, COVERED BRIDGE SHOPPING CENTER, PRATTVILLE, ALABAMA.
