OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an ejection from an aerial lift in excess of thirty feet from an extended basket due to tip over.      a) Wellington Pointe Apartments, Building 500; On or about April 25, 2017, and at times prior, the employer exposed employees to tip-over hazards in that the JLG aerial lift (Model 800A, SN 0300133513) operator did not ensure that the area where an aerial lift was used was inspected for possible hazards such as holes, slopes, bumps, or obstructions while attempting to repair and replace a soffit.
