29 CFR 1910.157(e)(1): The employer shall be responsible for the inspection, maintenance and testing of all portable fire extinguishers in the workplace:        On or about April 20,2017, the employer did not perform annual inspections or testing of all portable fire extinguishers at the workplace.  Fire extinguishers located throughout the production bays were not had not received there annual maintenance check. The last maintenance check(s) recorded on the service tag(s) was March of 2016.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:  Note:  Applies where all employees are expected to fight fires.  On or about April 20, 2017, employees working in the maintenance/service bay of the facility were not trained  on fire extinguisher use for incipient stage fires on an annual basis.  a)  Note the employer may exercise one of the following options:   1. Provide portable fire extinguishers as specified in 29 CFR 1910.157(c)(1), meet the distribution requirements per 29 CFR 1910.157(d) (75 to the nearest extinguisher for Class A fires and 50 to the nearest unit for Class B fires), and provide training and education for all employees in the use of such equipment and the hazards associated with incipient stage fire fighting as specified in 29 CFR 1910.157(g).  The other sections of 29 CFR also apply.   2. Provide extinguishers as specified in 29 CFR 1910.157(c)(1), designate certain employees to be the only employees authorized to use such equipment and require all other employees to immediately evacuate upon the sound of the fire alarm, establish this in writing in an emergency action plan as outlined in 29 CFR 1910.38(a) and train/educate designated employees per 1910.157(g).  Utilizing this option exempts the employer from distribution requirements of 29 CFR 1910.157(d).   3. Establish a written fire safety policy which requires the immediate and total evacuation of employees from the workplace upon the sounding of a fire alarm signal.  This policy shall include an emergency action plan and a fire prevention plan as specified in 29 CFR 1910.38(a) and 29 CFR 1910.39(a).  Utilizing this option exempts the employer from the requirements of 29 CFR 1910.157 to include the need for providing portable fire equipment unless a specific standard requires that a portable fire extinguisher be provided (such as those requirements in 29 CFR 1910.106/107 related to the use/storage of flammable/combustible liquids).  If extinguishers are provided, but not intended for employee use, 29 CFR 1910.157(e) and (f) are still applicable (inspection, maintenance, and testing of equipment).

29 CFR 1910.179(j)(2)(iii): Monthly inspections of hooks, with a certification record which includes the date of inspection, the signature of the person who performed the inspection and the serial number, or other identifier, of the hook inspected, were not performed:    On or about April 20, 2017, the employer did not ensure that hook inspections were performed and documented as required. Safety latches; affixed to the hooks/hoisting apparatus of the overhead bridge cranes located adjacent to the second bay (Fitting/Detailing) and in the 4th bay of the production area, were tied back with wiring. Employees performing crane operations are not protected from potential hazards created by accidental load disengagement.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about April 20,2017, the employer failed to ensure that various equipment or machinery used at the site was effectively guarded.  The unguarded equipment includes; but is not limited to, the following:      a. The unused portion of the blade; on the backside of the Wellsaw (swivel) horizontal band saw model # 1316, located in the finishing/detail area of the facility was unguarded exposing employees to the rotating blade.    b. The unused portion of the blade of the Wellsaw horizontal band saw, model # 1016 was unguarded, exposing the operator(s) to a point of operation hazard and/or unintentional contact with the rotating blade.     c. Guarding to prevent entry into the rear of the (Cincinnati) press brake, the Betenbender Shear and the Piranha Shear, located in the second bay (Fitting and detailing area) was not installed.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:     On or about April 20,2017, the employer did not ensure that the three prong adapter located in the second bay area was installed according to the listing or labeling. The adapter (which was designed for house-hold use) was plugged into a 4 outlet junction box, and the electrical cords of various pieces of commercial equipment with varying amperages were plugged into it. The wiring system was not GFCI protected, thus employees and others working in the immediate area were exposed to potential hazards created by dropped voltage(s) or over-current relays.
