29 CFR 1910.146(c)(5)(ii)(C): Before an employee entered a space, the internal atmosphere was not tested with a calibrated direct-reading instrument for oxygen, flammable gases and vapors and potential toxic air contaminants:    (a) On or about April 24, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) to engage in yeast pushing activities monitored the internal atmosphere of the space prior to entering the fermenter. Oxygen content and potential toxic air contaminants, in the form of carbon dioxide were not monitored prior to entering the space. Fermenters G1, G2, and, G3, at approximately 7:35 AM, 8:00 AM, and 8:25 AM respectively in Cellar 13 were not monitored for oxygen content prior to entering the space.    (b) On or about April 26, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) to engage in yeast pushing activities monitored the internal atmosphere of the space prior to entering the fermenter. Oxygen content and potential toxic air contaminants, in the form of carbon dioxide were not monitored prior to entering the space. Fermenters D1, D2, and, D4, at approximately 6:20 AM, 6:45 AM, and 7:35 AM respectively in Cellar 13 were not monitored for oxygen content prior to entering the space.    (c) On or about April 26, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) monitored the internal atmosphere of the space prior to entering the fermenters for the placement and retrieval of cleaning jets and inspections of the spaces during and after the cleaning process.    Note:  There wasn't sufficient GfG G460 Multi-gas Detectors for employees to monitor the space at the time of the inspection and at times prior. 29 CFR 1910.146(c)(5)(ii)(E)(1): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i) but continuous forced air ventilation was not used to eliminate any hazardous atmosphere prior to allowing an employee to enter the space:    (a) On or about April 26, 2017, and at times prior, the employer did not ensure that continuous forced air ventilation was utilized to eliminate potential hazardous atmospheres while employees were required to enter a permit required confined space (fermenters) using alternate procedures to perform yeast pushing activities. Fermenters were equipped with a vacuum-like ventilation system that drew in fresh air from an open lid on the foam chamber, which created a negative pressure atmosphere in the space.    (b) On or about April 26, 2017, and at times prior, the employer did not ensure that continuous forced air ventilation was utilized to eliminate potential hazardous atmospheres while employees were required to enter a permit required confined space (fermenters) using alternate procedures to perform cleaning activities such as placing and retrieving cleaning jets. Fermenters were equipped with a vacuum-like ventilation system that drew in fresh air from an open lid on the foam chamber, which created a negative pressure atmosphere in the space. 29 CFR 1910.146(d)(4)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that testing and monitoring equipment needed to comply with 29 CFR 1910.146(d)(5) was maintained properly:    (a) On or about April 26, 2017, and at times prior the employer did not ensure that testing and monitoring equipment such as the Crowcon Gasman Single Gas Personal Monitors and the GfG G460 Multi-gas Detectors were bumped checked prior to being utilized to monitor the permit required confined space as per the manufacturer.
