29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Angell Excavating & Services, LLC 4496 Zenobia St, Denver, CO 80212: On or before April 27, 2017, the exposing employer did not ensure that employees working inside a trench were protected from injury, in that the spoils pile was placed at the edge of the trench on the north side and less than two feet from the edge on the south side. The trench was approximately 5.4 feet wide at the opening, 5.4 feet deep, and 75 feet in length. This condition exposed the employees to the hazard of spoil pile material falling into the excavation or causing the excavation walls to collapse.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. (a) Angell Excavating & Services, LLC, 4496 Zenobia St., Denver, CO 80212: On or before April 27, 2017, the exposing employer did not ensure that each employee working inside a trench that was approximately 5 feet 4 inches wide at the opening, 5 feet 9 inches deep, and 75 feet in length was protected from cave-in, in that the trench was benched at an angle greater than the 45 degree maximum allowable slope for type B soil. This condition exposed employees to a crushing hazard by trench wall cave-in.
