29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    a)  43 West Market St., Jonestown, PA: On or about May 2, 2017, at the west side of the building, employees were accessing the 18 foot high work platforms, installed on the tubular welded frame scaffold, approximately 28 foot long, 5 foot wide and being used in masonry operations, by climbing up the walk through scaffold frames and crossbraces in lieu of using a ladder.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1m) above a lower level, not otherwise specified in paragraphs (g)(1)(I) through (g)(1)(vi) of this section, was not protected from falling to that lower level by use of personal fall arrest systems or guardrail systems meeting the requirement of paragraph (g)(4) of this section:    a) 43 West Market St., Jonestown, PA: On or about May 2, 2017, at the west side of the building, employees were observed working from the 18 foot high work platform which had been installed on the tubular welded frame scaffold, approximately 28 foot long, 5 foot wide and being used in masonry operations,  did not have a guardrail system installed around the platform.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a)  43 West Market St, Jonestown, PA: On or about April 27, 2017 an employee was observed doing abrasive media blasting from the basket of an aerial lift while elevated 15 feet off the ground. The employee was not wearing a harness or other fall protection device.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    a) On April 27, 2017, F.E. Horst Masonry, LLC. did not develop or implement a written hazard communication program in accordance with 29 CFR 1910.1200(e)(1) that would describe or include at least the following:    1) Requirement for labeling of containers of hazardous chemicals;  2) Safety data sheet availability;  3) Training of employees;  4) A complete list of hazardous chemicals known to be in the workplace;  5) Methods to inform employees of the hazards on non-routine tasks; and  6) Methods to inform other employer(s) of material safety data sheet availability; the labeling system; and any precautionary measures to protect employees.    Employees were exposed to hazardous chemicals such as but not limited to crystalline silica.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.
