29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   On or about June 20, 2017, and at times prior thereto, in the shop production area, where employees were exposed to noise hazard without a continuing, effective conservation program in place:  a) The Pallet Repair Technician was exposed to a noise level of 87.2 dBA during a 326 minutes sampling period on June 20, 2017;  b) The Pallet Repair Technician was exposed to a noise level of 94.45 dBA during a 386 minutes sampling period on June 20, 2017;and,  c) The Pallet Repair Technician was exposed to a noise level of 91.64 dBA during a 355 minutes sampling period on June 20, 2017.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   On or about June 20, 2017, and at time prior thereto, at this construction materials merchandise warehouse, employees were involved in loading and unloading wood pallets materials and products operations and were utilized powered industrial trucks (PITs) without training and evaluation from the employer:   a. Powered Industrial Truck Mitsubishi with one fork (2 vehicles); and,  b. Powered Industrial Truck Mitsubishi with double fork (1 vehicle).

Bosh Angle Grinder;  b. Dewalt Angle Grinder; and,  c. Angle Grinder (Model Unknown).
