29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):    On or about April 28 2017, and at times prior thereto, the employer did not perform frequent and regular inspections for safety hazards such as but not limited to; fall hazards and  no eye protection. Employees were exposed to these and other hazards at the apartment complex under construction.

29 CFR 1926.102(a)(1): 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    On or about April 28, 2017, and at times prior thereto, subcontracted employees were not protected by eye protection while performing construction work in the apartment complex under construction, exposing the employees to the hazards of being struck by flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    On or about April 28, 2017, and at times prior thereto, for work performed on the apartment complex under construction employees were not protected from falls over 6 feet in two instances.    a. Two subcontracted workers were installing chalk lines on the edge of the second floor and neither of the employees was protected by any fall protection devices.   b. Two subcontracted workers were installing plywood sheets on the edge second floor and neither of the employees was protected by any fall protection devices.
