29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103)  (a)  The employer did not perform an evaluation to identify the potential exposure to respirable dust containing silica for the construction site located at 200 E. Ryan Road Oak Creek, Wisconsin 53154 prior to employees using a 3M elastomeric tight fitting respirator during mechanical sanding of a concrete floor.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103)  (a)  On April 28, 2017, an employee performing sanding of a concrete floor at a construction site located at 200 E. Ryan Road Oak Creek, Wisconsin 53154, used a 3M elastomeric half-mask respirator with facial hair that would interfere with the seal of the unit.
