29 CFR 1910.28(b)(15): Walking-working surfaces not otherwise addressed. Except as provided elsewhere in this section or by other subparts of this part, the employer must ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level is protected from falling by: (i) Guardrail systems; (ii) Safety net systems; or (iii) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. Employees were exposed to a fall hazard from working at heights of approximately 15-30 feet, employees were required to stand on piles of walnuts stored in Bulk Bin 1 and Bulk Bin 2 as they guided them toward the floor augur system without an approved form of fall protection.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed: In that an examination of program elements determined that periodic inspections of energy control procedures were not accomplished and certified. Specifically, reviews were not conducted to determine if listed steps were still adequate, if any changes had occurred, or if employees had acquired the knowledge needed to effectively isolate energy sources.

Employees in Bulk Bin 1 and Bulk Bin 2, were exposed to a amputation hazard. The exposed sprocket and chain, on the David Brown Radicon gear reducer, located less than 7 feet from the floor which was not enclosed and guarded.

29 CFR 1910.272(g)(1)(ii): All mechanical, electrical, hydraulic, and pneumatic equipment which presents a danger to employees inside grain storage structures was not deenergized and disconnected, locked-out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods. Employees were exposed to amputation, crushed-by, and struck-by hazards. The employer did not deenergized and disconnected, lock-out, tag or, blocked-off powers sources in storage bins. Employees were required to work in grain bin while electric auger was powered and operational.
