On or about May 1, 2017 the did not inspect ground conditions around the Grove TMS300, 35 ton crane for proper support, including ground settling under and around outriggers/stabilizers and supporting foundations, ground water accumulation, soil compaction, or similar conditions.

29 CFR 1926.1402(e): If the A/D director or the operator determines that ground conditions do not meet the requirements in paragraph (b) of this section, that person's employer must have a discussion with the controlling entity regarding the ground preparations that are needed so that, with the use of suitable supporting materials/devices (if necessary), the requirements in paragraph (b) of this section can be met. a. On or about May 1, 2017 The employer did not take precautions to adjust ground conditions and proximity of the crane to the foundation wall, nor discussed with the controlling entity the soil conditions or soil compaction to ensure adequate ground conditions beneath the crane assembly to support the Grove TMS300, 35 ton Hydraulic Crane.

On or about May 1, 2017 the employer failed to ensure the Grove TMS300 Hydraulic crane received an annual inspection in accordance with this standard. The crane was purchased in November of 2014 and was in operation on May 1, 2017 with no annual inspection of the vehicle.

29 CFR 1926.1412(c)(1): 29 CFR 1926.1412(c)(1): Upon completion of assembly, the equipment was not inspected by a qualified person to assure that it is configured in accordance with manufacturer equipment criteria. a. On or about may 1, 2017 the full time employee/crane operator for Dimucci Companies did not inspect the crane after it was set up to ensure that it was configured in accordance with the manufacturer's equipment criteria. The crane operator attempted a lift over side and did not fully extend one outrigger which resulted in the eventual tip over of the crane during a lift.
