These tasks are reasonably anticipated to expose employees to blood or other potentially infections materials, including contaminated needles. 29 CFR 1910.1030(d)(2)(i): Engineering and work practice controls were not used to eliminate or minimize employees exposure:  (a)  On or about April 13, 2017, employees are exposed to needlestick injuries because the employer has not provided tools, engineering controls or work practices to prevent contact with potentially contaminated sharps during tasks where used needles could reasonably be anticipated, namely during housekeeping in resident rooms and while laundering resident clothing.  An employee was stuck by a used needle while cleaning a resident room.   Abatement Note:  Among other methods, feasible and acceptable abatement methods to correct this hazardous condition include, but are not limited to:  Providing brooms and dustpans along with a enforced employee work practice to sweep trash and debris with these tools to ensure hands do not reach into an area where hazards cannot be seen; provide to residents who use needles, to housekeepers, and in the laundry room, containers to collect used needles and sharps, that are closable, puncture resistant, leakproof on sides and bottom, and labeled or color-coded. 29 CFR 1910.1030(f)(1)(i): The employer did not make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure:  (a)  On or about April 13, 2017, and at times prior, the employer did not offer the hepatitis B vaccine to employees who have occupational exposure to blood and other potentially infectious material.   Abatement Note:  Ensure that each employee who declines the hepatitis B vaccine signs the declination statement found in 29 CFR 1910.1030 Appendix A, Hepatitis B Vaccine Declination (Mandatory), which reads:   I understand that due to my occupational exposure to blood or other potentially infectious materials I may be at risk of acquiring hepatitis B virus (HBV) infection. I have been given the opportunity to be vaccinated with hepatitis B vaccine, at no charge to myself. However, I decline hepatitis B vaccination at this time. I understand that by declining this vaccine, I continue to be at risk of acquiring hepatitis B, a serious disease. If in the future I continue to have occupational exposure to blood or other potentially infectious materials and I want to be vaccinated with hepatitis B vaccine, I can receive the vaccination series at no charge to me.
