29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): The employer is failing to ensure employees are protected from chemical burn hazards when conducting cleaning operations as part of monthly cleaning operations. The employer has not conducted adequate Job Safety Analysis (JSA) to allowing employees to work on the job site. This was most recently documented at 815 2nd Street, Kearney, Nebraska on or about April 22nd, 2017 when the employer had an employee cleaning the wheels of a table in the kitchen with inadequate gloves to protect them from splashes. The JSAs the company has completed did not address the chance of splashing during the process.

29 CFR 1910.1200(e)(1)(ii): The written hazard communication program did not include the methods the employer will use to inform employees of the hazards of non routine tasks, and the hazards associated with chemicals contained in unlabeled pipes in their work areas: The employer is failing to ensure that the company has a written hazard communications (HAZCOM) program which contains all of the elements required by this subpart. There is no provision in their written program as to how to deal with nonroutine or unlabeled piping in their facility. This was most recently documented at 815 2nd Street, Kearney, Nebraska on or about April 22nd, 2017 during an investigation of a chemical burn sustained by an employee of the company.
