This condition exposed employees to hazards including but not limited to fall hazards, impalement hazards, tripping hazards, and unsafe personnel points of access to the first floor where the change in elevation exceeded 19 inches.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs, debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures: (a) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling employer did not ensure that debris, scrap materials, and other items were kept clear of walking/working surfaces. The exterior courtyard on the 4th floor included sharp materials and fasteners on the walking/working surface. Staging areas on the 6th floor included discarded materials on the walking/working surfaces. These conditions exposed employees to tripping hazards. (b) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling and correcting employer did not ensure the area on the first level near the man lift was kept clear of items such as pipes, pallets and discarded fasteners laid out on concrete floor where employees accessed the work areas. (c) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling and correcting employer did not ensure the exterior courtyard on the 4th floor was clear of discarded scrap metal, broken wood, screws, nails and lacing wire.

29 CFR 1926.502(b)(13): When guardrail systems were used around holes which were used as access (such as ladderways), they were not provided with a gate, or were not so offset that a person could not walk directly into the hole: (a) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling employer did not ensure that the floor opening for the ladder on the 5th floor was adequately guarded by a gate or offset to protect employees from falls. This condition exposed employees to a fall hazard of approximately 12 feet; (b) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling employer did not ensure the floor opening for the ladder on the 6th floor was adequately guarded by a gate or offset to protect employees from falls. This condition exposed employees to a fall hazard of approximately 11 feet; and c) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling employer did not ensure the floor opening for the ladder on the 7th floor was adequately guarded by a gate or offset to protect employees from falls. Employees accessed this area to place materials, supplies, and trash. This condition exposed employees to a fall hazard of approximately 30 feet.

29 CFR 1926.502(j)(1): Toeboards were not erected along the edge of the overhead walking/working surfaces for a distance sufficient to protect employees below: (a) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, the controlling employer did not ensure that toe boards were installed in all areas, such as, but not limited to, the ladderways, and the 4th, 5th, 6th, and 7th floors, respectively, above where employees were working. These working areas included tools, materials, and supplies, such as portable tools, pipes, metal pieces and fasteners that were set in close proximity to the edge This condition exposed employees working on the lower levels to the hazard of being struck by falling tools, materials, supplies.

29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement: (a) Martines Palmeiro Construction, LLC at 3063 Brighton Blvd. Denver, CO: On or before 5/2/2017, as part of injury/accident prevention responsibilities under its safety program, the controlling employer did not ensure that each uncapped rebar was covered. The exterior courtyard on the 4th floor included at least two dozen pieces of uncapped rebar which had previously been covered with 2x4 boards and tie wire. The covering boards had long since been pushed aside, exposing the rebar. These conditions exposed employees to impalement hazards.
