29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a- 12 America Avenue, Lakewood NJ - A company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, while performing red masonry brick installation from a prefabricated, tubular, welded framed scaffold that was missing guardrails and end stops on the scaffold's walking/working surface. Condition observed on or about 05/03/17. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. a- 12 America Avenue, Lakewood NJ - A company employee was exposed to fall hazards, in excess of 25 feet to the ground surface below, while performing red masonry brick installation from a prefabricated, tubular, welded framed scaffold that was missing guardrails and end stops on the scaffold's walking/working surface. On the day of the worksite inspection, the exposed employee and the company owner had not received scaffold hazard recognition and minimization training by a qualified person. Condition noted on or about 05/03/17. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
