29 CFR 1926.451(g)(4): Guardrail systems installed to meet the requirements of this section shall comply with the following provisions (guardrail systems built in accordance with Appendix A to this subpart will be deemed to meet the requirements of paragraphs (g)(4)(vii), (viii), and (ix) of this section): 29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. a. On or before May 3, 2017, where an employee was working from an elevated platform, the platform did not have the toprail chains installed, thereby exposing the employee to a 12 foot fall hazard. b. On or before May 3, 2017, where an employee was working from an elevated platform, the platform did not have midrails on the sides or ends, thereby exposing the employee to a 12 foot fall hazard.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. a. On or before May 3, 2017 where employees were conducting roofing work, the employees were not protected from falls by the use of guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system, thereby being exposed to a 12 foot fall hazard.

29 CFR 1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a. On or before May 3, 2017, where a forklift was modified to be used to hoist employees by the use of a platform, the capacity, operation, and maintenance instruction plates, tags, or decals were not changed, thereby exposing employees to fall, struck-by, or other hazards.
