29 CFR 1903.19(d)(1): The employer did not submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  A Plus Roofing and Restoration, LLC failed to provide documentation demonstrating the abatement method and completion of the following items as cited:      a) Citation 1, Item 1: Establish and maintain safety program that provided jobsite safety     b) Citation 1, Item 2a: Provide fall protection for employees exposed to fall hazards greater than six feet      c) Citation 1, Item 2b: Provide employees with fall protection training.     d) Citation 1, Item 3a:  Provide safe ladder set up and use to gain access to roof      e) Citation 1, Item 3b: Ensure that ladder equipment is safe and free of damage, and missing slip resistant feet     f) Citation 2, Item 1: Failed to provide record of training

29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with accident prevention; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a)  On or about May 4, 2017 at 105 N State Street in Waupaca, the employer did not conduct adequate safety inspections prior to employees working on a roof surface at 15 ft. above surface level.  No conventional fall protection equipment installed and the access/egress ladder positioned on slippery surface was not secured and had a tripping hazard at the base.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a)  On or about May 4, 2017 at 105 N State Street in Waupaca, employees were working on a roof surface at 15 ft. above surface level without utilizing conventional fall protection equipment.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards; such as, the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:   a)  On or about May 4, 2017 at 105 N State Street in Waupaca, employees were exposed to fall hazards without receiving adequate training on the use of conventional fall protection equipment.  Employees were using slide boards with roof jacks as fall protection equipment during roofing work.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.  a)  On May 4, 2017 at 105 N State Street in Waupaca, employees were using an unsecured extension ladder on a slippery surface to access/egress a roof at 15 ft. above surface level.  The ladder slip resistant feet were placed on a tarp which was covering a grassy surface.

The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  a)  The employer did not provide written employee fall protection safety training certification for employees who were working on a roof surface on May 4, 2017 at 105 N State Street in Waupaca, Wisconsin.
