29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average (TWA) of 85 dBA, the employer did not develop and implement a monitoring program: a) Facility, Sealing/Filling Rooms: The employer did not provide a monitoring program for employees conducting filling and sealing operations who were exposed to noise above 8-hour TWA of 85 dBA. Employees were exposed to continuous noise levels of 89 dBA, 91.9 dBA, 89.1 dBA 89 dBA, 89 dBA, and 91.0 dBA for an 8-hour TWA, which is equivalent to a dose of 87.89%, 130.5%, 89.04%, 87.93%, 87.72%, and 128.2% respectively. These exposures exceed the Action Level of 85 dBA. Sampling time were 406:57, 398:09, 387:14, 383:00, 411:00, and 423:00 minutes respectively. Zero exposures were assumed for all unsampled time periods. Violation noted on 29 JUN 2017.

29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 dBA in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program. a) Facility, Sealing/Filling Rooms: The employer did not provide training for all employees in the Filling and Sealing Rooms who were exposed to noise levels at or above 8-hour TWA of 85 dBA. Employees were exposed to continuous noise levels of 89 dBA for an 8-hour TWA, which is equivalent to a dose of 87.89%. This exposures exceed the Action Level of 85 dBA. Sampling times were 406:57 minutes. Zero exposures were assumed for all unsampled time periods. Violation noted on 29 JUN 2017.
