29 CFR 1910.28(b)(6)(ii): Each employee 4 feet (1.2 m) or more above dangerous equipment was not protected from falling by guardrail systems, safety net systems, travel restraint systems or personal fall arrest systems.      Operator side of the rock crusher:  On or about May 2, 2017, and times prior to, employees operating a rock crusher during the recycling of concrete pieces stood on the guardrail  and mid-rail without additional fall protection  to observe the interior of the crusher feed hopper.  This exposed them to fall and caught in hazards.

29 CFR 1910.146(c)(3):     When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces:    Rock Crusher: On or about May 2, 2017, employees operated a rock crusher during the recycling of concrete pieces.  The employer had not taken effective measures to prevent employees from entering permit confined spaces including but not limited to : feed hopper, crushing chamber, and internal portions of the conveyor system.  This exposed the employees to caught in, struck by, inhalation, and engulfment hazards.

29 CFR 1910.147(c)(4)(ii)(B): The energy control procedures did not clearly and specifically outline the steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy.      Rock crusher:  On or about May 2, 2017, employees operated heavy equipment during the recycling of concrete pieces and the energy control procedures adopted by the employer did not include specific steps for controlling stored energy from hydraulic, mechanical, and gravitational sources.   This exposed employees to caught in and struck by hazards.

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):    Concreted crushing operation:  On or about May 3, 2017, and times prior to, employees operated a crushing operation to recycle concrete.  The safety data sheet for the concrete was not maintained or accessible.  This exposed the employees to the hazard of silica.
