29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a. On or about May 9, 2017 at the Starbucks #912 project, on the north east side of the building, two employees were installing fascia board along the roof line and were working on the top tier of a two tier welded tubular scaffold system and were not protected by any means of personal fall protection, guardrails or safety nets, exposing them to falls in excess of 13 feet to the ground below.

On or about May 9, 2017 at the Starbucks #912 project, on the north east side of the building, two employees were installing fascia board along the roof line and were working on the top tier of a two tier welded tubular scaffold system and were not protected by means of guardrails installed along all open sides and ends of the platforms, exposing them to falls in excess of 13 feet to the ground below.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below: a). On or about May 9, 2017 the employer did assure toeboards were erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below. Employees were cutting light frame metal stud materials on a work bench on the ground and then walking through the scaffold system to install the studs in and along the side of the structure. These employees were not protected from struck by or falling items from above, by toeboards erected along the edge of the working platform of the scaffold system above.
