Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.    a) On or about May 10, 2017 on a commercial building at 214 Grand Avenue in Wausau, employees were working on a low slope roof surface at 12 ft. above surface level without utilizing conventional fall protection equipment.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toe-boards, safety net systems, or personal fall arrest systems.  a) On May 10, 2017 on a commercial building at 214 Grand Avenue in Wausau, employees were working on an 8:12 pitched roof surface at greater than 12 ft. above surface level without utilizing conventional fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:  a) On or about May 10, 2017, the employer did not provide training for an employee who was exposed to a fall hazard without receiving adequate training on the use of conventional fall protection equipment.  The employee was using slide boards and roof jacks as safety equipment for work on a roof.

When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee; circumstances where retraining is required include, but are not limited to changes in the types of fall protection systems or equipment to be used render previous training obsolete:  a) On or about May 10, 2017, the employer did not provide retraining for employees who were exposed to fall hazards without receiving adequate retraining on the use of conventional fall protection equipment.  The employees were working on low and steep sloped roof surfaces using slide boards with roof jacks as fall protection.
