OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of struck-by:      (a)  On or about 05/09/17 - job site, in front of 59-30 54th Street, Maspeth, NY     Employees installing water mains were exposed to the hazard of being struck-by the CAT 345C excavator.  While the operator was attempting to reposition the undercarriage frame of the excavator by placing the bucket on the street.  While doing so the bucket shifted and struck an employee who was checking the clearance between the machine and a fence.  The employee was pinned between the bucket and a trench box.    ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19
