Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while refurbishing multi-former headbox of a paper manufacturing equipment. On or about May 10, 2017, an employee had just removed that last of the bolts from the top section (roof membrane) of the multi-former headbox, weighing approximately 4,000 pounds, in order to separate it from the bottom casting when the top section slid off of the bottom casting and struck the employee.
